Today, when the matter is taken up for hearing, both the learned counsels appearing for the appellant and the respondent reported that both the appellant and respondent died. Appellant died in the year 2009 and recorded.

2.Till date, the learned counsel for the appellant has not taken steps to implead the legal heirs of the deceased appellant and respondent in the appeal.

3.Hence, the Second Appeal stands dismissed as abated. No costs.
