Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to cancel the patta issued as Patta Nos.1340 and 1341 in the name of the respondents 3 and 4 for the Survey Nos.134/1C and 134/1B, after sub-diving the petitioner joint family property of bearing Survey Nos.134/1A, 179/4, situated at Kadugu Santhai Revenue Village, Kadaladi Taluk, Ramanathapuram District by considering the petitioner's representation, dated 14.10.2020. For Petitioner : Mr.R.Murugappan For R-1 and R-2 : Mr.J.John Rajadurai, Government Advocate.

ORDER

It appears that the petitioner had given a representation to the first respondent / the Revenue Divisional Officer, Paramakudi, Ramanathapuram District, questioning the grant of patta to the third and fourth respondents herein. The first respondent had, in turn, sought a report from the second respondent / the Tahsildar, Kadaladi Taluk, Ramanathapuram District. An inquiry is pending on the file of the first respondent. The Writ Petition has been filed seeking a direction to the first respondent to pass orders. That, in fact, is the actual relief sought in the Writ Petition.

2. Heard Mr.J.John Rajadurai, learned Government Advocate, who takes notice for the first and second respondents.

3. In view of the nature of the order passed, notice is not directed to the third and fourth respondents.

4. Let the first respondent, after receiving the report from the second respondent / the Tahsildar, Kadaladi Taluk, Ramanathapuram District, issue notice to the petitioner and also to the third and fourth respondents, hear all the parties and thereafter, take a decision with respect to grant or otherwise of patta relating to the lands in Survey Nos.134/1C and 134/1B at Kadugu Santhai Revenue Village, Kadaladi Taluk, Ramanathapuram District. The entire exercise should be completed within a period of sixteen (16) weeks from the date of receipt of a copy of this order.

5. With the said observations, this Writ Petition is disposed of. There shall be no order as to costs.
