RESPONDENT/RESPONDENT/ RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed on the petitioner in order dated 10.01.2013 in MP.NO.1/2013 in CRl.A(MD)No. 7/2013 pending disposal on the file of this Honourable court.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. M.SHAJAHAN, Advocate for the petitioner and of MR.K.K.RAMAKRISHNAN, Additional Public prosecutor for the Respondent the court made the following order:- In M.P.(MD) No.1 of 2013 in Crl.A.(MD) No.7 of 2013, this Court suspended the sentence and released the petitioner on bail by order dated 10.01.2013, on the following conditions: "4.Under the above facts and circumstances of the case, the substantive sentence of imprisonment alone is suspended, pending disposal of the Criminal Appeal, the petitioners are ordered to be enlarged on bail on their executing a bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate and Special Judge, Tirunelveli, and on further condition that the petitioner shall appear before the said Court on the first working day of every month at 10.30 a.m. until further orders."

2. The petitioner has filed the present petition seeking for relaxation of the bail conditions.
3. In the opinion of this Court, there cannot be any complete relaxation of the aforesaid conditions because the petitioner should be available to undergo the sentence of imprisonment in the event of appeal being dismissed. However, if the petitioner is not able to appear before the Trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C., and shall appear before the Trial Court on any other day in lieu of the date of his absence, as directed by the Trial Court.
