Whereas this Petition filed under Article 226 of the Constitution of India, Praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 5 to forbear the 6th respondents quarrying operations in the government land in Survey No. 165(part), Puthur Village, Rajapalayam Tk, Virudhunagar Dt forthwith and consequently, to direct the respondents 1 to 5 to take appropriate action as against the 6th respondent for his above illegal quarrying operations by duly conducting appropriate and unbiased enquiry by considering the petitioners representation dated 27.11.2020.

Whereas this Court hath in its order dated 25.01.2021 and made herein appointed to Ms.M.Kanimozhi, ([Enrollment No.3047/2019), Madurai Bench of Madras High Court, Madurai, (Mobile No.8940493944) as Advocate Commissioner, to cause an inspection over the land, which is subject matter of the license granted, in and by the proceedings of the District Collector, in favour of the respondent No.6 situated in Rajapalayam Circle, Puthur Village, S.No.165 with an extent of 5.56.5 Hectares and file a report; Therefore, you namely Ms.M.Kanimozhi, ([Enrollment No.3047/2019), Madurai Bench of Madras High Court, Madurai, (Mobile No.8940493944) as Advocate Commissioner, to cause an inspection over the land, which is subject matter of the license granted, in and by the proceedings of the District Collector, in favour of the respondent No.6 situated in Rajapalayam Circle, Puthur Village, S.No.165 with an extent of 5.56.5 Hectares and file a report;
2. The respondent Nos.4 and 5 shall give adequate assistance to the learned Advocate Commissioner. There is no need for the Advocate Commissioner to put the respondent No.6 on notice. Such a report will have to be filed before this Court on the next hearing date on 17.02.2021;
3. The remuneration to the Advocate Commissioner is fixed as Rs.25,000/- [Rupees Twenty Five Thousand only], to be paid by the petitioner, The petitioner is also at liberty to accompany the learned Advocate Commissioner;
4. The learned Advocate Commissioner is also at liberty to indicate in the report about any other possible violation to the license issued at the hands of the respondent No.6 including excess removal of the stones.
The matter stands posted on 17.02.2021.
