The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 85 of BNS and Section 318(4) of BNS, in Crime No.Not known of 2025 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the defacto complainant pledged 400 gms of gold ornaments to the first petitioner, but the first petitioner failed to give the said gold though the defacto complainant is ready to pay Rs.40,00,000/-. Hence, the complaint.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. He further submitted that the petitioners are ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioners. 2/4
4. The learned Government Advocate(Crl. side) submitted that the investigation is pending.
5. Considering the facts and circumstances, this Court directs the petitioners to appear before the respondent police daily at 10.30 a.m, till 30.01.2026 and co-operate for the enquiry.
6. Post the matter on 30.01.2026. The respondent police is directed not to arrest the petitioners till then. Further, the respondent police is directed to file a status report on 30.01.2026 without fail. 09.01.2026 PJL Note:Issue order copy on 28.01.2026.
