Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, in Crime Number 104 of 2010 on the file of the respondent police, apprehends arrest at the hands of the respondent police, in pursuant to the non-bailable warrant issued by the Fast Track Mahila Court, Ramanathapuram in S.C.No.77 of 2012 for the alleged offence under Section 366 I.P.C. 2.The learned counsel for the petitioner submitted that the petitioner has been regularly appearing before the trial Court since 2012 and he could not appear before the Court on 18.08.2012 due to suffering from viral fever. The learned counsel for the petitioner also submitted that the petitioner is having reasonable apprehension that he may be arrested by the respondent police. He would further submit that the petitioner undertakes to appear before the Trial Court on all future hearings.

3.Heard the learned Government Advocate (Crl.side).

4. Considering the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

5. Accordingly, the petitioner is ordered to be released on bail in https://hcservices.ecourts.gov.in/hcservices/ the event of arrest or on his appearance before the learned Judicial Magistrate, Paramakudi and on executing a bond for a sum of Rs.10,000/-

(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court on all the dates of hearings except on those days by filing a petition under Sections 317 Cr.P.C. by assigning valid reasons. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
