RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extend the time fixed in Crl.O.P.(MD).No.683/2017 dated 02.02.2017 for the production of sureties Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.C.M.ARUMUGAM, Advocate for the petitioner and of MR.K.SUYMABULINGA BHARATHI, Government Advocate(Crl.side) on behalf of the Respondent the court made the following order:- This petition has been filed to extend the time granted by this Court in Crl.O.P.(MD).No.683 of 2017 dated 02.02.2017.
2. The case of the prosecution is that the petitioner, who is the husband of the defacto complainant harassed the defacto complainant by demanding more dowry. Hence, the case has been registered for the alleged offences punishable under Sections 498(A), 294(b), 406, 323 and 506(ii) of IPC., and Section 4 of Dowry Prohibition Act, in Crime No.23 of 2016. Subsequently, this Court has granted anticipatory bail to the petitioner in Crl.O.P.(MD).No.683 of 2017, dated 02.02.2017 with some conditions. But the petitioner did not comply the said conditions. Hence, he approached this Court by way of filing this petition.
3. The submissions made by the learned counsels appearing for both side are considered. The respondent police registered the case for the alleged offences punishable under Sections 498(A), 294(b), 406, 323 and 506(ii) of IPC., and Section 4 of Dowry Prohibition Act, in Crime No.23 of 2016. Earlier on 02.02.2017, this Court granted https://hcservices.ecourts.gov.in/hcservices/
anticipatory bail in favour of the petitioner with a direction to surrender before the learned Judicial Magistrate, Nilakottai, within a period of 15 days from the date on which the order copy was made ready, after executing a bond for a sum of Rs.10,000/- with two sureties each for a like sum. But, so far, the petitioner herein has not surrendered before the Court concerned and filed this application for extension of time. Accordingly, this application has been filed after a lapse of one year from the date of order. Eventhough, the learned Government Advocate (Criminal side), has not raised any specific objection for extending the time, considering the period of delay, this Court is inclined to extend the time for a period of two weeks, subject to the condition that the petitioner has to deposit Rs.3,000/- as cost, to the Hon'ble Chief Justice Relief Fund within a period of one week from the date of receipt of a copy of this order. On such deposit, the petitioner is directed to surrender before the Court concerned within a period of 15 days.
