This second appeal has been filed against the judgment and decree dated 31.12.2002 passed by the Principal District Court, Nagercoil, in A.S.No.129 of 2001 reversing the judgment and decree dated 09.10.2001 1/3

passed by the Additional District Munsif Court, Nagercoil, in O.S.No. 126 of 1997.

2. When the matter came up for hearing, the learned counsel for the appellants submitted that the matter has been settled out of Court and he has also made an endorsement to that effect.

3. Recording the same, this second appeal is dismissed as settled out of Court. No costs.
