ORDER

This Civil Revision Petition is filed to expedite disposal of the Appeal in A.S.No.154 of 2018 on the file of the Subordinate Court, Dindigul.

2. Heard both sides.

3. On the side of the petitioner, it is stated that against the order passed in O.S.No.339 of 2013, the revision petitioners preferred an appeal in A.S.No.154 of 2018 on the file of the Subordinate Court, Dindigul and hence, the petitioners seek a direction for speedy disposal of A.S.No.154 of 2018.

4. On the side of the respondent, it is stated that the respondent also filed an appeal in A.S.No.43 of 2018, which is pending before the Principal Sub Court, Dindigul, against the same order (O.S.No.339 of 2013), and hence, disposing of appeal will not serve the purpose,

5. Since both the appeals (A.S.No.154 of 2014 and A.S.No.43 of 2018) are against the same judgment passed in O.S.No.339 of 2013, this Court directs that the appeal in A.S.No.154 of 2018 on the file https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P(MD) No.107 of 2020 of the Subordinate Judge, Dindigul, is to be withdrawn and the same is transferred to the filed of the Principal Subordinate Judge, Dindigul. The Principal Subordinate Judge, Dindigul, is directed to dispose both the appeals within a period of two months from the date of transfer of A.S.No.154 of 2018.

6. With the above direction, this Civil Revision Petition is disposed of. No costs.
