FOR ANTICIPATORY BAIL IN CRIME NO. 198 OF 2022 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(C) r/w 20(b)(ii)(B) and 25 of NDPS Act, 1985, in Crime No.198 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that on 23.07.2022, based on the secret information, the respondent police conducted ride near Pasingapuram Burial Ground. At that time, on seeing the police, the accused persons attempted to escape from the place. However, the police secured A1 to A3 and on search, it was found that the accused persons were in illegal possession of 2 kgs of ganja. The petitioner herein escaped from the place of occurrence.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he prayed to grant anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that there are four previous cases pending as against the petitioner and hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the bad previous antecedents of the petitioner, this Court is not inclined to grant 2/3

anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
