ORDER

This Criminal Original Petition has been filed to accept the surrender of the petitioner before the learned Special Court for the exclusive trial for PCR Cases, Theni in connection with the Crime No.8 of 2026 on the file of the 2nd respondent police and to consider the bail application filed by this petitioner on the same day.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The prosecution case is that the defacto complainant, belonging to a Scheduled Caste community, was subjected to defamation and outraging of modesty by Accused Nos.1 and 2 through mobile chat messages, which were allegedly forwarded by the petitioner. Based on the complaint lodged by the defacto complainant, FIR has been registered for the offence under Sections 356(2), 79 of BNS r/w 3(1)(r), 3(1)(s) of Schedule Caste and Schedule Tribes 2/5

(Prevention of Atrocities) Amendment Act, 1989 & 67 of IT Act in Crime No.8 of 2026.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Special Court for the exclusive trial for PCR Cases, Theni, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.8 of 2026 on the file of the 2nd respondent police.
