PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents to carry out the spelling mistakes in the column of the father's name as "S.Mookkan" instead of "S.Mookkaiah" in the Transfer Certificates of the petitioner on the basis of her representation dated 23.09.2013 and to issue Fresh Certificates forthwith in accordance with law For Petitioner : Mr.M.Veilkaniraju For R1-R3 : Mr.V.Nirmal Kumar Government Advocate For R4 : No Appearance For R5 : Mr.S.Anwar Sameem
ORDER
The present writ petition has been filed seeking a Writ of Mandamus as against the respondents directing them to change the name of the petitioner's father as "S.Mookkan" instead of "S.Mookkaiah" in the Transfer Certificate issued by the fourth and fifth respondents' institution.
2. According to the petitioner, her father's name is S.Mookkan and it has been wrongly incorporated as S.Mookkaiah in the Transfer Certificate issued by the fourth and fifth respondents' institution. A perusal of the typedset of papers indicates that in the Community 2/5
Certificate of the writ petitioner, her father's name is shown as S.Mookkan and the Birth Certificate of the writ petitioner also indicates the name of her father as S.Mookkan. The family Card also indicates her father's name as S.Mookkan. The petitioner's father is a Government servant and an Identity Card has been issued to him, which discloses the name of the petitioner's father as S.Mookkan.
3. However, by mistake, in the Transfer Certificate issued by the fourth and fifth respondents' institution, the name of the petitioner's father had been incorporated as S.Mookkaiah. In view of large number of official documents indicating the name of the petitioner's father as S.Mookkan, this Court is inclined to pass the following orders: (i) The fourth respondent institution is directed to issue a duplicate Transfer Certificate to the writ petitioner incorporating the name of her father as S.Mookkan in the place of S.Mookkaiah within a period of four weeks from the date of receipt of a copy of this order.

(ii) On production of the said corrected Transfer Certificate, the fifth respondent institution is directed to rectify the defect and issue a fresh Transfer Certificate.
4. With the above said observations, this Writ Petition stands allowed. No costs.
