ORDER
(1)The present petition is filed by the petitioner seeking relaxation of the condition imposed by this Court vide order dated 28.11.2025, made in Crl.A.(MD).No.1257/2025.
(2)The learned counsel for the petitioner submitted that this Court, vide order dated 28.11.2025, granted bail to the petitioner, directing him to stay at Mayiladuthurai, and report before the Inspector of Police, Mayiladuthurai Police Station, daily at 10.30 a.m., until further orders. The learned counsel submitted that the petitioner is a daily wage coolie and is a sole breadwinner of the family. The learned counsel submitted that the condition imposed by this Court not only affected the petitioner's livelihood, but also caused him severe financial strain. The learned counsel submitted that in view of the averments stated in the affidavit, the condition imposed may be totally relaxed.
(3)The learned Government Advocate [Crl.Side] appearing for the respondents 1 and 2 submitted that the petitioner complied with the conditional order from 05.12.2025 to 13.01.2026 only and thereafter, he failed to comply with the aforesaid condition and hence, he prayed that the petitioner may not be shown any indulgence by this Court.
(4)Heard both sides and perused the materials placed on record. (5)On due consideration of the averments made in the affidavit, this Court is of the view that the condition imposed on the petitioner, may be modified.
(6)Accordingly, the petition is ordered and the petitioner is directed to report before the Trial Court, on every Monday at 10.30 a.m., until further orders. The other conditions imposed in the order dated 28.11.2025 remain unaltered.
(7)It is needless to state that the petitioner shall also appear before the Trial Court on all dates of hearings without fail.
