ORDER
This Criminal Original Petition is filed to transfer the investigation of the petitioner's complaint in CSR No.97 of 2025 from the second respondents to any other investigating agency in light of her representation dated 19.12.2025.
2. The learned counsel for the petitioner submitted that the petitioner is the de facto complainant whose son-in-law went missing all of a sudden. Earlier, her daughter filed a Habeas Corpus petition before this court and HCP(MD)No.1461 of 2025. when the matter came up for hearing, the police had informed this Court that the petitioner's son-inlaw had eloped with another woman namely Priyatharshini and they got married for the second time. On that basis, the said Habeas Corpus petition came to be closed on 16.12.2025. Pursuant to the same, the petitioner had given a complaint as against her son-in-law in which CSR.No.97 of 2025 came to be issued. However, there is no progress in the investigation, seeking action on the petitioner's complaint, this Criminal Original Petition came to be registered. 2/6
3. Learned counsel for the petitioner submitted that the petitioner's daughter is having a female child. It has came to the knowledge that the said Priyatharshini is pregnant now. The second respondent police had never bothered either to register first information report or investigate the matter and take appropriate action against the petitioner's son-in-law and also to take action against the said Priyadharshini with whom he is living.

To ascertain whether the petitioner's son-in-law was married to another woman namely Priyadharshini, the Investigating Officer Ms.S.A.G.Sahaya Shanthi, Inspector of Police, Srivaikundam All Women Police Station, Thoothukudi District, is before this Court and when the matter came up for hearing and when this Court raises specific question to the Investigating Officer as to the destination at which the petitioner's son-in-law is living with the said Priyadarshini, she was uncertain as to the same and that would show clear dereliction of duty on the part of the investigating officer since she herself had informed this Court that the petitioner's son-in-law had appeared before her along with her along with Priyadarshini for inquiry. Despite the same day, the investigation officer has not proceeded to conclude the investigation and registered first information report.

Hence, this court directs transfer of the investigation of the case in CSR No.97 of 2025, pending before the second respondent police to the file of the Inspector of Police, Tiruchendur All Women Police Station Police Station, Thoothukudi District and the latter is directed to conclude the enquiry within two weeks from the date of receipt of a copy of this order, by registering a first information report, take appropriate action against the petitione's son-in-law and the said Priyadharshini.
