PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent (Tamil Nadu Information Commission) to give decision order within a reasonable time frame against the RTI case No.SA/10786/E/2022 against which enquiry was conducted in 20.06.2023 by the respondent.

The writ petition has been filed for a direction to the respondent (Tamil Nadu Information Commission) to give decision order within a reasonable time 1/5

frame against the RTI case No.SA/10786/E/2022 against which enquiry was conducted in 20.06.2023 by the respondent.

2. With the consent of both parties, the writ petition is taken up for final disposal.

3. The petitioner filed an application for information from the Public Information Officer, District Revenue Department as per Section 6(1) of the Right to Information Act. Neither the Public Information Officer nor the appellate authority provided a satisfactory information to the petitioner, the petitioner therefore preferred second appeal under Section 19(3) of the Right to Information Act before the Tamil Nadu Information Commission. The respondent registered second appeal as case No.SA/10786/E/2022 and conducted an enquiry on 20.06.2023. According to the petitioner, though the respondent orally decided that the petitioner should be furnished the required information in a months time but no decision in writing was rendered by the respondent. The petitioner states that till date no written orders are passed by the respondent, inspite of the petitioner's reminders. As the petitioner's second appeal is pending without final decision, the petitioner filed the above writ petition for the aforesaid relief.

4. Without going into the merits of the case, it is seen that the second appeal filed by the petitioner was registered as case No.SA/10786/E/2022 and the enquiry was conducted on 20.06.2023. Though the enquiry was conducted as early as on 20.06.2023, no final orders have been passed till date. The petitioner is a senior citizen aged about 76 years and information provided by the Public Information Officer, District Revenue Department was not satisfactory to the petitioner.

Considering that the petitioner is a senior citizen and his second appeal is kept pending since 2022, I am inclined to issue direction to the respondent to pass final orders in the petitioner's second appeal on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order.

6. Accordingly, writ petition stand disposed of with the above direction. No costs.
