ORDER

This Criminal Original Petition has been filed seeking a direction to direct the respondent to complete the investigation and to file a final report in Crime No. 5 of 2016 on the file of the third respondent police now in the hands of the second respondent police

2. Today, when the matter is taken up for hearing the learned Additional Public Prosecutor would submit that the respondent police have completed investigation and also filed final report. He would also submit that originally a case was registered was under Section 174 of Cr.P.C and thereafter the case was referred to the Executive Magistrate for enquiry with the First Information Report and the original First Information Report has been misplaced. The Executive Magistrate has also given a letter stating that the original First Information Report has been misplaced. Though the final report have been filed before the concerned court the learned Magistrate is returning the final https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.843 of 2020 report directing the Investigating Officer to present along with the original First Information Report. The respondents are handicapped without the original First Information Report and they are ready to file carbon copy of the First Information Report.

3. In view of the same, the respondent police is directed to file final report with the carbon copy of the First Information Report and the learned Magistrate is directed to take final report on file with the carbon copy of the First Information Report.
