The present writ petition has been filed challenging the auction notice issued by the second respondent herein, fixing the date of sale as 07.05.2012. According to the Counsel for the second https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD).No.5838 of 2012 respondent, no sale has taken place on 07.05.2012 for want of bidders. The said fact is also reflected in the counter filed by the second respondent. Since no auction has taken place as contemplated under the impugned auction notice, nothing survives to be adjudicated in the present writ petition.
2. Recording the same, the Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed.
