Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to repay the amount of Rs.57,698/- which has been paid as deposit for temporary electricity connection along with reasonable interest by considering the petitioner's representation dated 04.12.2023 within a stipulated time that may be fixed by this Court.

ORDER

The petitioner has prayed for issuance of a Writ of Mandamus, directing the respondents to repay the amount of Rs.57,698/- which has been paid as deposit for temporary electricity connection along with reasonable interest by considering the petitioner's representation dated 04.12.2023 within a stipulated time that may be fixed by this Court.

2. Heard Mr.CN.Tamizharasan, learned counsel appearing for the petitioner and Mr.S.Deenadhayalan, learned Standing Counsel appearing for the respondents.

3. By consent, this writ petition is disposed of at the admission itself. 2/6

4. According to the petitioner, the petitioner had constructed a house in Survey No.1289/10,1 at Kodukkimundan Ambalam street, Ponnamaravathy. At the time of construction, he applied for temporary electricity connection through TENGEDCO online Portal on 24.06.2022 and a sum of Rs.57,698/- has been paid as temporary deposit through his son Sakthiram State Bank Account bearing No.33058895669.

After completing the payment receipt No.PGNSBI14016497 and Service No.200061890622416 had been assigned to him. On 27.06.2022 the petitioner came to know that unfortunately some entries were wrongly mentioned in the service connection. Thereafter, the petitioner had approached the Assistant Engineer, TNEB at Ponnamaravathy along with his son Sakthiram and made an application for cancellation of the temporary connection and that the same was cancelled and on the very same day, he gave an another application to refund the deposited money. But there was not proper reply from the concerned authorities. Therefore, on 04.07.2023 the petitioner had given a grievance petitioner to the Hon'ble Chief Minister regarding the said issue. After receiving the complaint, the third respondent has sent a communication letter dated 04.08.

response from the third respondent. Subsequently, on 04.12.2023 the petitioner has sent a detailed representation to the respondents to refund the amount of Rs. 57,698/-. Since the respondents did not take any action on the representation, the petitioner has approached this Court by way of filing the present Writ Petition for the relief stated supra.

5. The learned Standing Counsel appearing for the respondents would submit that appropriate direction may be given to the respondents to dispose of the representation of the petitioner dated 04.12.2023, in accordance with law, within a time frame.

6. Considering the limited scope of the prayer sought for by the petitioner, without going into the merits of the matter, this Court directs the respondents to refund the amount of Rs.57,698/- to the petitioner within a period of two (2) weeks from the date of receipt of a copy of this order.
