PRAYER: Petition filed under Section 11 of the Contempt of Court Act, 1971, to punish the contemnors / Respondents herein for the willful disobedience of the order passed by this Court in W.P.(MD) No.8491 of 2023 dated 17.04.2023.

O R D E R

This Contempt petition is filed to punish the contemnors / Respondents herein for the willful disobedience of the order passed by this Court in W.P.(MD) No.8491 of 2023 dated 17.04.2023.

2. The writ petition in W.P.(MD) No. 8491 of 2023 was disposed of on 17.04.2023, directing the respondents to conduct an enquiry, provide an opportunity to the petitioner, and thereafter pass appropriate orders. If, based on the outcome of the enquiry, the petitioner is found not entitled, the respondents shall recover 50% of the amount, and the remaining 50% shall be waived. The respondents have since issued a notice to the petitioner.

3. The contention of the petitioner is that no opportunity was granted to the petitioner. Be that as it may, the respondents have finally passed an order on 24.02.2025. In contempt proceedings, no further hearing can be granted. Therefore, this Court is of the considered opinion that the respondents have complied with the order passed by this Court.

4. Accordingly, this Contempt Petition is closed. The petitioner is at liberty to challenge the order passed by the respondents dated 24.02.2025. The petitioner is entitled to raise the plea that proper opportunity was not granted before passing the order. 13.06.2025 Index : Yes / No Internet : Yes KSA
