PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus or any other writ or order in the nature of writ directing the respondent to repay the Earnest Money to a tune of Rs.5,01,500/- deposited in the Auction sale conducted on 30/08/2024, 31/08/2024 to the petitioner within a stipulated time.

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ of mandamus has been instituted to direct the respondents to repay the earnest money to the tune of Rs 5,01,500/- deposited in the auction sale conducted on 30.08.2024 and 31.08.2024 to the petitioner.

2. Accepting the conditions in the e-auction notice, the petitioner paid the earnest money to participate in the e-auction. 2/4

3. Admittedly, the petitioner participated in the e-auction process. That being so, the relief as such sought for in the present writ petition cannot be granted.

4. Accordingly, the writ petition stands dismissed. There shall be no order as to costs.
