RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition made in para 9 of the order dated 14.12.2020 made in Crl.O.P(MD)No.12001 of 2020 on the file of this Hon`ble court.
Order :This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.J.LAWRANCE, Advocate for the petitioner and of Mr.M.CHANDRASEKARAN, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This petitioner has been filed to modify the condition No.9 imposed by this Court in Crl.O.P(MD) No.12001 of 2020 dated 14.12.2020.
2. The learned counsel for the petitioner would submit that this Court while granting anticipatory bail to the petitioner had directed the petitioner to deposit original title deed which stands in the name of the petitioner, or his relatives or his friends, not less than value of Rs.15 Crores with proper valuation certificate issued by the Revenue Divisional Officer to the credit of the crime number, which is not proper, hence he seeks modification of the said order.
3. The learned Additional Public Prosecutor would submit that there are 452 depositors and the amount involved is Rs.96 Crores. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.468 of 2021 The property so far attached is less than the value of the amount. He would also submit that at the time of passing order this Court had expressed its opinion and directed the petitioner to deposit a sum of Rs.30 Crores and at the request of the petitioner, the amount has been reduced to Rs.15 Crores and objected to modify the condition.
4. On perusal of the order it is seen that earlier Mr. P.Kumaresan, learned counsel appeared in this case and the present counsel appearing for modification petition was not counsel on record while arguments were advanced. Anticipatory bail was granted on the factual aspects and it cannot be now countenanced, hence this Court is not inclined to modify the condition.
