ORDER

Heard the learned counsel appearing for the petitioner, the learned Additional Public Prosecutor appearing for the first respondent and the learned counsel appearing for the defacto complainant.

2. This Criminal Original Petition has been filed for quashing the impugned FIR. When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that the final report has been made ready and the petitioner has been shown as A.4. But then, the learned Additional Public Prosecutor would state that the petitioner is figuring as fourth accused. The defacto complainant had categorically states before this Court that the petitioner's name has been wrongly included and therefore, he has no objection for deleting the petitioner's name. Crl.O.P.(MD)No.1040 of 2022 the second respondent, the first respondent is directed to delete the name of the petitioner while filing the final report before the jurisdictional Court. In other words, the impugned prosecution stands quashed as far as the petitioner is concerned. This Criminal Original Petition is allowed on these terms. Consequently, connected miscellaneous petition is closed.
