ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused in Crime No.204 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 24.04.2015 for the alleged offences punishable under Section 302 of I.P.C., and hence, seeks bail. 2.The case of the prosecution is that the accused had illicit relationship with the deceased and on 23.04.2015 due to misunderstanding, the accused stabbed the deceased with knife on her chest and killed her.
3.The learned counsel for the petitioner submitted that the deceased along with her mother and sister borrowed more than Rs.10 lakhs from the accused and due to non-payment of the amount, the wife of the accused lodged a complaint in CSR No.185 of 2015 to the respondent on 11.04.2015 and later a false complaint was given against the petitioner. He further submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) would submit that the petitioner had stabbed the deceased with knife on her chest and caused her death and major part of the investigation is over. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions.
6.Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Andipatti and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.
