When the matter is taken up for hearing today, the learned counsel appearing for the appellant would submit that he has no instruction from the appellant and he has also filed a Memo, dated 31.01.2019, stating that there is no response from the appellant and hence, the appeal may be dismissed as no instruction. It appears that the appellant has no interest in prosecuting the case. Hence, the Second Appeal is dismissed for non-prosecution. No costs.
