PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 3rd respondent to send proposal for grant of cost assignment (assignment patta) in respect of the punja land in Survey No.74PA/2 to the extent of 0.03.00 Ares situated at Arumulai Village, Orathanadu Taluk, Thanjavur District, and consequential direction to the 1st respondent to consider the same and pass appropriate order on the basis of the petitioner's application dated 21.02.2022 and 17.03.2022 in accordance with G.O(Ms) No.248 Revenue (LD-I(2) Department dated 28.07.2009 and G.O.(Ms) No.60 Revenue (LDIII(1) Department dated 05.02.1999.

ORDER

The Writ Petition is filed, seeking a direction to the third respondent to send proposal for assignment of the land situated in Survey No. 74PA/2 with an extent of 0.03.00 Ares, at Arumulai Village, Orathanadu Taluk, Thanjavur District, in the light of G.O(Ms) No.248, Revenue (LD-I(2) Department, dated 28.07.2009.

2. The petitioner herein submitted an application before the third respondent on 21.02.2022, seeking assignment of the subject property on payment of cost. Subsequently, public notice was issued by the respondent, seeking objections from the public. Since there was no objection, the third respondent sent a communication to the Sub-Registrar concerned for fixation of cost of the subject land in his proceedings Na.Ka.No.2172/2022/Aa2, dated 28.07.2022. The Sub-Registrar, Pappanadu, in his letter, dated 01.08.2022, submitted his proposal regarding the cost of the land before the third respondent. Even thereafter, there is no progress on the request made by the petitioner for assignment of the subject land. Therefore, the petitioner submitted a reminder letter before the first respondent on 09.09.

2022, requesting him to fix the cost of the subject property to enable the petitioner to pay the same and seek assignment. Thereafter, the second respondent in his proceedings, dated 13.09.2022, in Na.Ka.28/2022/A2, directed the petitioner to approach the third respondent and submit necessary documents. Even though the petitioner appeared before the third respondent and submitted necessary documents, the request of the petitioner has not been considered. Therefore, the petitioner has come before this Court with the above mentioned prayer.

3. The Additional Government Pleader, appearing for the respondents, would submit that the second respondent would submit that the representation of the petitioner will be considered in accordance with law.

4. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the first respondent to consider the representation of the petitioner, dated 09.09.2022, and pass final orders within a period of twelve weeks from the date of receipt of copy of this order.

5. Accordingly, the Writ Petition is disposed of. No costs. 25.06.2025 NCC :
