For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 4 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.2, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323 and 354 of IPC, in Crime No.4 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that due to property dispute, the petitioner abused the defacto complainant in filthy language and also assaulted her. Therefore, the present case came to be registered.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. The petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner and the defacto complainant are neighbours. 4.The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that no one has sustained injury in the alleged occurrence.

5.Considering the facts and circumstances of this case and also the fact that no one has sustained injury in the alleged occurrence, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

No.755 of 2022 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or her appearance, before the learned Judicial Magistrate, Lalgudi, and on her executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police on every Saturday at 10.30 am until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
