ORDER
Seeking direction to the first respondent herein to withdraw case in Crime No.652 of 2024 on the file of the second respondent and entrust the investigation to the third respondent or some other investigation agencies for further investigation, this criminal original petition is filed.
2.The learned counsel for the petitioner submitted that the petitioner gave a complaint with regard to his mother's death, following which, the respondent police has registered FIR in Crime No.652 of 2024 for the offence under Section 194 of BNSS. It is the contention of the petitioner that the postmortem certificate of his mother reveals that his mother died, due to electrocution. However, till date, the respondent police failed to alter the sections. Since the respondent police is not 2/5
conducting a fair investigation, the petitioner has approached this Court seeking the aforesaid prayer.
3.The learned Government Advocate (crl.side) appearing for the respondent police, on instructions, submitted that FIR was registered for the offence under Section 194 of BNSS. The petitioner's mother, who is the labour working in the farm, died due to electric shock. Subsequently, section was altered and the owner of the land is arrayed as an accused. He further submitted that the investigation is going in a proper manner and there is no necessity to transfer the investigation. 4.Recording the submission of the learned Government Advocate (crl.side), this Court hereby directs the second respondent to conclude the investigation in Crime No.652 of 2024 within a period of eight weeks from today (i.e., 19.01.2026). However, the 1st respondent police is directed to monitor the investigation from time to time. The second respondent is directed to appraise the progress of the investigation 3/5
every Friday, till the conclusion of the investigation, to the first respondent.
5.With the above directions, this Criminal Original Petition is disposed of.
