This Criminal Original Petition has been filed seeking reinvestigation on the ground that on the date of conspiracy, the petitioner was in Coimbatore and on the date of alleged occurrence, he was with the mother-in-law i.e., 40 kms. away from the place of occurrence.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side).

3. Admittedly, the investigation is over and the matter is pending for committal. Once the matter is taken up by the jurisdictional Magistrate, the petitioner can very well file an application under Section 173(8) of Cr.P.C. Hence, this Criminal Original Petition is dismissed.
