...Respondent

PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the learned Judicial Magistrate, Fast Track Court, Nagercoil to expedite the trial in S.T.C.No.101 of 2023 within a time frame fixed by this Court. For Petitioner : Mr.P.Kalaiyarasi Bharathi

ORDER

This petition is filed seeking direction to the learned Judicial Magistrate, Fast Track Court, Nagercoil to expedite the trial in S.T.C.No.101 of 2023. 1/4

2. The grievance of the petitioner is that though the petitioner filed a private complaint under Section 200 Cr.P.C, against the respondent for the offences punishable under Section 138 read with Section 142 of the Negotiable Instrument Act, in the year 2023 in S.T.C.No.101 of 2023, the same has not been disposed of till date.

3. Mr.P.Kalaiyarasi Bharathi, learned counsel for the petitioner would contend that though speedy trial is guaranteed under Constitution of India, the case in STC No.101 of 2023 has been frequently getting adjourned from time to time. He therefore prayed for disposing the case within the time frame stipulated by this Court.

4. It is seen from the records that the STC is of the year 2023 and the learned counsel appearing for the petitioner also stated that the case is now posted for hearing arguments on both sides. In the facts and circumstances, the Judicial Magistrate, Fast Track Court, Nagercoil is directed to dispose of STC No.101 of 2023 as expeditiously as possible. 2/4

5. With the above observations, this Criminal Original Petition is disposed of.
