ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A) I.P.C. and Sections 3 and 4 of Dowry Prohibition Act in Crime No. Not known of 2015 on the file of the respondent police, seek anticipatory bail.
2. Heard the learned Counsel for the petitioners and the learned Government Advocate (Crl.Side).
3. No regular case has been registered. Only petition enquiry in C.S.R.No.16 of 2015 is pending. This Court granted interim anticipatory bail to the petitioners on 17.02.2015 with a direction to the second petitioner to appear before the respondent police for enquiry. The petitioners complied with the orders of this Court and the interim anticipatory bail was extended from time to time on the assurance given by the petitioners that they will pay a reasonable amount as compensation to the defacto complainant. The petitioners have gone back upon their words.
4. On a reading of the complaint, the allegations appears to be very serious. Inasmuch as after having married the defacto complainant, the petitioners have subjected her to cruelty and the second petitioner also deserted her. Under these circumstances, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioners.
