Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to transfer the investigation in Crime No.148 of 2015 dated 08.05.2015 pending on the file of the third respondent to the fourth respondent.

ORDER

This Criminal Original Petition has been filed to transfer the investigation in Crime No.148 of 2015 dated 08.05.2015 pending on the file of the third respondent to the fourth respondent.

2. The petitioner is the wife of the deceased. Seeking transfer of investigation, she has come forward to file this petition.

3. The learned counsel for the petitioner submitted that there is a collision with the de-facto complainant and the respondent No.3 and the de-facto complainant has admitted himself without any injury. The deceased died after suffering the substantial injuries. Therefore, the investigation may be transferred. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.side) submitted that the petitioner is not co-operating even by producing the vehicle.

5. Be that as it may, it appears that the petitioner is not having confidence with the investigating officer and she has lost her husband.

6. Considering the same, this Court is inclined to direct the second respondent to transfer the investigation from the third respondent to any other Investigating Officer under the control of second respondent.
