ORDER

This Civil Revision Petition has been filed to set aside the order passed in memo in O.S.No. 127 of 2016, on the file of the District Munsif, Vadipatti dated 28-06-2022.

2. A report has been placed on record by the learned Principal District Judge, Madurai, after enquiry with the respective parties, wherein it has been admitted by one Dhanapal, the son-in-law of the deceased second plaintiff that he had impersonated the second plaintiff and he has also put the signature in the plaint and other documents. This admission substantiate the fraud that had been committed in a Court proceedings which is not only an act of perjury but also a act of abuse of process of law.

3. In such view of the matter, the learned Principal District Munsif, Vadipatti, is directed to initiate criminal complaint under the provisions of the Indian Penal Code as against the persons named in the report for having committed the act of perjury.

4. Since it has come to light that the suit itself had been filed by impersonation, the suit in O.S.No.127 of 2016 shall be struck off from the register of the Court below. However, the interlocutory application filed by the petitioner in I.A.No.117 of 2023 shall be independently disposed of by the learned Judge.

5. Registry is directed to keep the entire bundle in a sealed cover and transmit it back to the learned District Munsif, Vadipatti.

6. This Court places its appreciation for the enquiry that had been conducted by the learned Principal District Judge, Madurai, in submitting the report within the time.

7. With the above observation, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
