O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the third respondent in No.42/thaku.2/2025 dated 23.12.2025 and direct the third respondent to grant three days emergency leave without escort to the petitioner's husband Prakash, S/o.Arikrishnan, Convict No.42/ PID No.576152 presently confined in Central Prison, Palayamkottai.
2. It is the case of the petitioner that her brother was convicted by the Principal District and Sessions Judge, Nagercoil in S.C. No.193 of 2005 on
14.06.2007 and sentenced to seven years imprisonment under Section 307 of IPC. Aggrieved over the same, the convict has filed a revision before this Court in Crl.RC(MD) No.900 of 2017 and this Court has altered the conviction to section 326 of IPC and imposed three years rigorous imprisonment and a pay a sum of Rs.50,000/- as compensation to the victim. The petitioner submitted an application seeking emergency leave for a period of three days. After considering the request made by the petitioner, the third respondent has granted three days emergency leave to the petitioner's husband with escort. The petitioner being a poor person, could not afford the cost of escort.
3. In view of the above, the condition imposed in the order dated 23.12.2025 directing the convict to go on emergency leave with escort is modified and he shall go on emergency leave without escort. However, the convict is directed to comply with the usual conditions imposed by the jail authorities and he should also report before the fourth respondent police daily at 05.30 p.m. He shall duly comply with the conditions and return to the prison on expiry of the leave period.
4. Accordingly, the order of the third respondent dated 23.12.2025 is quashed in sofar as the ordering escort alone and the Writ Petition is disposed of.
