ORDER
This Writ Petition has been filed seeking a Writ of Certiorarified Mandamus, calling for the records relating to the order of rejection passed in Na.Ka.No.01/O.PE.A/KA.U.AA/A.NA.SA/M.MA/2022 dated 04.01.2023 on the file of the first respondent and quash the same as illegal and consequently directing the respondents to permit the petitioner to hold agitation (Kandana Aarpattam) for the cause mentioned in the application of the petitioner dated 30.12.2022 to be held on 12.01.2023 or any other subsequent dates at the place of Ambiga Theatre, Anna Nagar, Madurai by using Mike set with police protection.
2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 2/4
3. The learned Additional Public Prosecutor appearing for the respondents would submit that the accused house is situated surrounding the proposed place for holding agitation.
4. At this juncture, the learned counsel appearing for the writ petitioner would submit that they are ready to change the place.
5. Recording the submissions made on either sides, the writ petitioner is directed to give a fresh representation before the second respondent indicating the proposed place and on such representation, the second respondent is directed to consider the same and pass orders within a period of three days from the date of representation.
6. With the above directions, this Writ Petition stands disposed of. No costs.
