ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police based on the NBW 1/4

issued by the trial Court, for the offences punishable under Sections 294(b), 307, 323, 326, 379 and 506(ii) of IPC, in Crime No.489 of 2015, on the file of the respondent police, which was taken on file as S.C.No.135 of 2017, seeks anticipatory bail.

2. The learned Government Advocate (Crl.side) submitted that it is a case of jumped out bail. Therefore, this petition will not be maintainable.

3. Considering the facts and circumstances of the case and also the fact that it is a case of jumped out bail, the petitioner is directed to surrender before the trial Court and file a recall petition. The petitioner is further directed to file an undertaking affidavit that he will appear for all hearing dates before the trial court without fail, at the time of filing recall petition. On such filing of recall petition, the learned Sub Judge, Padmanabhapuram, is directed to consider the recall petition on the same day.

4. With the above direction, this Criminal Original Petition is disposed of.
