... Respondent/Complainant PRAYER :- This Criminal Original Petition filed under Section 438 of Criminal Procedure Code to enlarge the petitioner on Bail in the event of their arrest or surrender in Crime No.121 of 2019 on the file of the Respondent Police.

ORDER: This Criminal Original Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Balakrishnan, Advocate for the Petitioner and of Mr.K.Suyambulinga Bharathi, Government Advocate(Criminal Side) for the respondent this Court made the following order:

This Court by order dated, 29.01.2021 on finding that there is no total non-cooperation by the respondent police in giving instructions to the learned Government Advocate (Criminal side) and thereby, the learned Government Advocate (Criminal side) is unable to assist this Court. Hence, this Court had directed the Superintendent of Police, Kanyakumari District to ensure that the Inspector of Police to be present before this Court with the Case Diary today (i.e.04.02.2021). Despite copy of the order sent to the Inspector General of Police, South Zone, Madurai and the Superintendent of Police, Kanyakumari District, No proper reporting.

2.Today, when the matter is taken up for hearing, the Inspector of Police is not present. Hence, notice to be sent to the Director General of Police, Chennai, who shall ensure the presence of the Superintendent of Police, Kanyakumari District along with the Inspector of Police to give explanation before this Court on 15.02.2021. This instruction is necessary, since the police officers from Kanyakumari District are not responding to the notice calling for instruction from the Pubic Prosecutor Office as well as the https://hcservices.ecourts.gov.in/hcservices/

Court. Hence, it is necessary to bring this to the notice to the Director General of Police, Chennai.

3.Post the matter on 15.02.2021.
