PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the respondents 1 to 3 to accord police protection to the petitioner for his agricultural operation in the land in Survey No.89/3 situated at Puthur Village, Trichy Taluk & District.

For Petitioner : No Appearance For Respondents : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor, for R1 to R3.

: No Appearance, for R4 to R8.

ORDER

The Writ Petition has been filed to issue a Writ of Mandamus, to direct the respondents 1 to 3 to accord police protection to the petitioner for his agricultural operation in the land in Survey No.89/3 situated at Puthur Village, Trichy Taluk & District.

2. When the matter is taken up for hearing today, there is no representation on behalf of the petitioner.

3. The learned Additional Public Prosecutor appearing for the State would submit that the petitioner is a tenant under the fourth respondent and 2/4

the dispute is with regard to the tenancy right and that during the pendency of this petition, the petitioner has surrendered the land to the owner/fourth respondent and nothing survives for further adjudication.

4. He would further submit that the petitioner has appeared before the third respondent and gave a letter stating that the property in dispute situated in Survey No.89/3 situated at Puthur Village, Trichy Taluk & District, was already handed over to Thiru.P.Rangaraju,/fourth respondent; that there are no case pending as of now and that he is not interested in proceeding with the petition filed before this Court.

5. Recording the said submission made by the learned Additional Public Prosecutor, this Writ Petition is dismissed as infructuous. No costs. 26.08.2022 das 3/4
