ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, apprehends arrest at the hands of the respondent police in pursuance of the non-bailable warrant issued by the Special Court for TANPID Act, Madurai on 27.02.2013, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that though the case was registered in the year 2011, the petitioner was not arrested during investigation and the respondent laid the charge sheet showing the petitioner as an absconding accused and thereafter, non-bailable warrant was issued on 27.02.2013. It is further submitted that the respondent has taken attachment proceedings and the same is pending before the Special Court in O.A.No.2 of 2013 and the property worth of Rs.1,00,16,000/- has been attached by the respondent for the alleged misappropriation of Rs.56,50,000/-.

3. The learned Government Advocate (Crl.side) submitted that the petitioner has been in abscondance for more than 3 years and the trial has already commenced.

4. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on her appearance before the Special Court for TANPID Act, Madurai and https://hcservices.ecourts.gov.in/hcservices/

on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the Special Court for TANPID Act, Madurai all future hearing dates without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

5. The petitioner shall appear before the concerned Court within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
