ORDER

(Order of the Court was made by G.K.ILANTHIRAIYAN,J.) The order dated 09.11.2025, passed by the first respondent, rejecting the petitioner's request for grant of ordinary leave, is under challenge in this writ petition.

2. The husband of the petitioner was convicted in S.C.No.84 of 2007 by the learned Sessions Judge, Karur on 29.11.2005 for the offences under Section 302 of IPC and sentenced to under go life imprisonment. Against which the convict has also preferred an appeal before this court in Crl.A(MD) No.98 of 2009 and the same was confirmed by this Court. While being so, the petitioner being wife of the convict submitted representation seeking 30 days ordinary leave to renovate the house and also to arrange funds for education expenses of her daughter. On receipt of the same, the first respondent by an order dated 09.11.2025 rejected the

request made by the petitioner on the ground that the convict is facing trial in another case.

The learned counsel appearing for the petitioner submitted that for the past several years the applications submitted for ordinary leave and emergency leave was rejected and it was challenged before this Court and only after the intervention of this Court emergency and ordinary leave were granted to the convict. This time also by citing the very same reason the first respondent rejected the request made by the petitioner seeking leave. In fact in pending case he was acquitted. Therefore citing those cases the first respondent rejected the request made by the petitioner seeking ordinary leave.

The learned Additional Public Prosecutor, on instructions, submitted that the convict on an earlier occasion when the was granted he did not surrender tin time thereby another case was registered in Crime No.191 of 2007 therefore the convict is not entitled for leave thereby the first respondent has rightly rejected the request made by the petitioner.

5. Though earlier applications were rejected which were challenged before this Court and thereafter this Court considering the request made by the petitioner

granted emergency leave and ordinary leave.

6. In view of the same, this Court considering the facts and circumstances inclined to grant ten days ordinary leave to the convict without escort.

7. Accordingly, the writ petition is disposed of with the following directions:

(i) The respondents are directed to grant ten days emergency leave without escort to the convict, namely, namely Arumugam, S/o.Paramasivam, Life Convict, Prisoner bearing Life Convict Prisoner No.17268, PID No.36398 confined at Central Prison, Trichy from 14..01.2026 to 23.01.2026. The Convict prisoner shall be released from the prison on 14.01.2026 at 9.00 a.m., (ii) He shall report back to the Superintendent of Prison, Trichy/ 2nd respondent, by 23.01.2026 at 6.00 pm., (iii) During the leave period the convict shall report before the third respondent daily at 5.30 pm., (iv) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities,

(v) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
