Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the 3rd respondent in Rc.No. 168692/AP.3(1)/2018 dated 15.12.2018 and quash the same as illegal on the basis of the Circular Memorandum issued by the 3rd respondent in Rc.No.74176/Con 3(1)/93 dated 12.11.2009 and consequently direct the respondents to return the recovered amount of Rs.10,640/- and Rs.14,896/- and re-fix the pensionary benefits in the basic pay of Rs.66,200/- as on 01.01.2019 to the petitioner. ORDER

The petitioner is a retired Police Inspector. While he was in service, he was issued with a charge memo and imposed with a punishment of stoppage of increment for a period of one year in PR No. 12/17 dated 18.01.2018. Aggrieved over the same, the petitioner has preferred an appeal before the 4th respondent and the same was rejected by order dated 04.07.2018. Further, the review filed by the petitioner before the 3rd respondent was rejected by order dated 15.12.2018. Therefore, the petitioner has filed a mercy petition before the second respondent and the same is pending. Now, the petitioner has filed this 2/5

writ petition, challenging the order of punishment dated 15.12.2018 that it is an unimplementable punishment, as per Circular Memorandum in Rc.No.74176/Con 3(1)/93, dated 12.11.2009. The petitioner has also sought for a consequential relief to re-fix the pensionary benefits and to return the recovered amount.

2. This Court is not inclined to grant the relief sought for by the petitioner. Since the mercy petition is pending before the second respondent, the petitioner shall workout his remedy before the second respondent in the mercy petition.

3. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 12.01.2026 ogy Index : Yes / No.
