ORDER

The present writ petition had been filed seeking a direction as against the third respondent to grant building plan approval to the writ petitioner for putting up construction in R.S.No.131/2C2A1A & R.S.No.131/6B of Valvachagoshtam A Village, Kalkulam Taluk, Kanyakumari District based upon his application dated 11.11.2022.

2.According to the learned counsel appearing for the writ petitioner, the property was measured by Tahsildhar, Kalkulam in the presence of the third respondent and it has been specifically pointed out that these two survey numbers are private patta lands.

3.In such circumstances, the third respondent cannot have any legal impediment to consider the request of the petitioner for grant of building plan approval.

4.Considering the above said facts, the petitioner is directed to give a request to the third respondent enclosing a copy of the proceedings of the Tahsildhar dated 23.01.2025. On receipt of the said representation, the third 2/4

respondent is directed to pass orders on the building plan application of the writ petitioner within a period of four weeks from the date of copy of the representation.

5.With the above said direction, this writ petition stands disposed of. No costs.
