O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to dispose of the appeal in Appeal No.136/24227/2025 dated 21.06.2025, pertaining to UDR Patta for the southern portion of 5 cents in S.F.No.197/24, situated at M.Pudupatti West Village, Musiri Taluk, Tiruchirappalli District, within a stipulated time.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fifth to seventh respondents, since no adverse orders are proposed to be passed against them.

3. The grievance of the petitioner is that the subject property in S.F.No.197/24 (Old S.F.No.221/24) originally belonged to the petitioner's Page No. 2 of 6

grandfather. The southern side, to an extent of 5 cents, in the said survey number was allotted to the petitioner's father and the northern side, to an extent of 5 cents, was allotted to the fifth respondent, who is the brother of the petitioner's father. Subsequently, the said land was subdivided.

4. The fifth respondent submitted a representation to the fourth respondent seeking cancellation of the subdivision and mutation of patta. The sixth and seventh respondents are the sisters of the fifth respondent. Based on the said representation, the fourth respondent forwarded a report to the third respondent. Thereafter, the third respondent passed an order dated 27.05.2025 directing cancellation of the subdivision and the patta mutation.

5. Aggrieved by the same, the petitioner filed an appeal before the second respondent on 21.06.2025, which was taken on file as Appeal No. 136/24227/2025. However, no order has been passed in the said appeal till date. Hence, the petitioner has filed the present Writ Petition.

6. The learned Government Advocate appearing for the first to fourth respondents, on instructions, would submit that the petitioner's Page No. 3 of 6

appeal would be disposed of by the second respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to dispose of the petitioner's appeal in Appeal No.136/24227/2025 dated 21.06.2025 on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The appeal shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, private respondents and any other interested parties who may be affected by such decision before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
