Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 2 and 3 to dispose the proceedings in O.Mu.No. 5605/Pa/2023, dated 28.12.2023 based on the petitioner representation, dated 17.07.2023 within the stipulated time may be fixed by this Court.

ORDER

The present writ petition has been filed seeking a direction to the respondents 2 and 3 to dispose the proceedings in O.Mu.No. 5605/Pa/2023, dated 28.12.2023 based on the petitioner's representation, dated 17.07.2023 within the stipulated time fixed by this Court. 2.By consent of both parties and considering the limited relief sought for by the petitioner, this Writ Petition is taken up for final disposal at the stage of admission itself. Considering the limited scope and relief sought for in the petition, notice to the fourth and fifth respondents is dispensed with. 2/5

3.Heard, the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3. Perused the materials on record.

4.The petitioner was temporarily appointed at CMCHIS Ward Manager by the Medical Officer, Government Hospital, Thiruthangal and he is working since 01.06.2017 in the said post. The fifth respondent is a Junior Assistant, who is restraining the petitioner and other staff from doing their jobs without any Authority. The petitioner made a complaint before the fourth respondent on 26.08.2022. On receiving the complaint, the fourth respondent referred the same to the third respondent for further proceedings. Though an enquiry was conducted, final order is not yet passed. Hence, this petition came to be filed.

5.The learned Special Government Pleader appearing for the respondents 1 to 3 submitted that the second respondent would complete the enquiry within a period of six weeks from the date of receipt of copy of this order.

6.Recording the said submission, the second respondent is directed to pass final orders, on the enquiry conducted as against the fourth respondent, based on the complaint given by the petitioner, pending in O.Mu.No. 5605/Pa/2023, dated 28.12.2023, within a period of six (6) weeks from the date of receipt of a copy of this order.

7.With the above direction, this writ petition stands disposed of. There shall be no order as to costs.
