The prayer in this writ petition is to issue a Writ of Mandamus, restraining the 2nd to 5th respondents from removing the Pan Shop No.4533 located at KM 155/2 (Right Side) of Madurai - Kanyakumari Road, (Abandoned NH-7 Tirunelveli Town Limit) without issuing show cause notice (removal of encroachment) as mandated by the Act and further direct the 6th and 7th respondents to restore the electricity connection in Service No.070020211804 to the Pan Shop No.4533 located at KM 155/2 (Right Side) of Madurai - Kanyakumari Road (Abandoned NH-7 Tirunelveli Town Limit), by considering the petitioner's representation dated 10.01.2024 as expeditiously as possible within a time frame to be fixed by this Court.

Today, when the matter is taken up for hearing, learned counsel appearing for the petitioner would submit that it is suffice if the petitioner's representation dated 10.01.2024 is directed to be considered and disposed of by the respondents within a time frame.

The learned counsel for the respondents would submit that the petitioner's representation dated 10.01.2024 will be disposed of by the respondents within a time frame to be fixed by this Court.

Recording the above submissions, the Writ Petition is disposed of directing the respondents to consider the petitioner's representation dated 10.01.2024 and pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner and it is upto the respondents to decide whether Pan Shop in question is to be removed or it can be given under lease purely on merits. No costs.
