ORDER

This writ petition has been filed for the following relief : "directing the 1st respondent to effect service connection to the petitioner's house situated in S.No. 491/6, S.No.491/7 and S.No.491/8 from the pole situated on South of Natham Poromboke S.No.151 Konkapatti, Ethiload Village, Nilakottai Taluk, Dindigul District within a time limit fixed by this Court."

It is the case that the petitioner is the owner of the property measuring an extent of 3545 square feet comprised in Survey nos.491/6, 491/7, 491/8 of Konkapatti, Ethiload Village, Nilakottai Taluk, Dindigul District. The property was settled in her favour by her son under a registered settlement deed, dated 12.10.2020.

3. The petitioner had put up a construction after obtaining necessary approval and had also obtained electricity service connection bearing Service No.250-012-1706. The connection was drawn from the

pole situate on the opposite side of the petitioner's house. Between the pole and the petitioner's house is the Vilampatti road. The petitioner's case is that heavy goods vehicles ply on this road to the paper mills and the pole poses a risk, therefore, she had sought for re-allocation of her service connection from the pole which is situate in the other side to Natham Poramboke Survey No.151 which is the property of the 2nd respondent.

The 2nd respondent raised an objection to this by stating that his mother had filed O.S.No.110 of 2022 on the file of the District Munsif Court, Nilakottai against the petitioner to declare the settlement deed executed in favour of the petitioner as null and void and on account of this objection, the petitioner's representation dated 16.12.2022 is not being considered. Therefore, the petitioner is before this Court.

5. Heard the learned counsels on either side.

A perusal of the photographs which has been annexed by the petitioner would itself clearly show that there is absolutely no risk in continuing the existing line and the allegations of risk of electrocution is nothing but a figment of the petitioner's imagination. The pole from which the lines are drawn is a sturdy electrical pole. However, if the request of the petitioner for shifting the service connection is considered, the lines would run across the 2nd respondent's property. The existing line poses a problem to none. Hence, the request of the petitioner for shifting the electrical pole is not feasible.
