2017 Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.JANATH AHMED, Advocate for the petitioner and of on behalf of the Respondents the court made the following order:- This Petition has been filed to extend the time to surrender and for filing warrant recall petition before the III Metropolitan Magistrate Court, Kolkata as per the conditional order passed by this Court in Crl.O.P.(MD)No.13521 of 2017, dated 06.10.2017. 2.The submissions made by the learned counsels on either side are considered.
3.Initially, when order passed in Crl.O.P.(MD)No.13521 of 2017, this Court granted interim anticipatory bail, in which, the petitioner was directed to execute a personal bond for a sum of Rs.10,000/- with two sureties to the satisfaction of the respondent Police or the Police Officer. petitioner to appear before the concerned Court on or before 01.08.2018, in which, the case has been pending (West Bengal). 4.Without complying with the order passed by this Court, the petitioner filed this petition to extend the time for appear before the concerned Court. The reasons stated by the petitioner to extend the time is not satisfied this Court. Hence, this Court is not inclined to extend the time.
Accordingly, this Criminal Miscellaneous Petition is dismissed.
