RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed by this Honorable Court that the petitioner shall appear before the respondent police daily i.e. evening at 5.30 P.M until further orders in Crl.OP.No.17905/2017 dated 22.12.2017 in Crime No.478/2017 on the file of the respondent police.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.LAJAPATHI ROY, Advocate for the petitioner and of MR.K.SUYAMBULINGA BHARATHI, Government Advocate (Crl.Side) for the Respondent the court made the following order:- This Petition has been filed to relax the condition imposed by this Court in Crl.O.P(MD)No.17905 of 2017, dated 22.12.2017. 2.Heard the learned counsel appearing for the petitioner. 3.The learned Government Advocate(Criminal side)appearing for https://hcservices.ecourts.gov.in/hcservices/ the respondent submitted that the petitioner has complied the

condition from 09.01.2018 onwards and investigation is still pending.

4.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Criminal side) that the investigation is still pending. As per the order of this Court dated 28.12.2017, the petitioner was directed to appear before the respondent Police daily evening at 05.30 p.m. until further orders and the petitioner was appeared before the respondent Police from 09.01.2018 onwards. Admittedly, it would appear that the petitioner was complied with the condition, only for 15 days. Accordingly, this Criminal Miscellaneous petition is dismissed.
