ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1 in Crime No.189 of 2015 on the file of the respondent police, was remanded to judicial custody on 04.05.2015 for the alleged offences punishable under Sections 341, 294(b), 307 and 302 I.P.C., and hence, seeks bail. 2.The case of the prosecution is that while the deceased walking along with his friend the second and third accused restrained them and they used filthy language and the petitioner assaulted the deceased with Vettu Kathi on the right thigh and subsequently the deceased fell down and died.

3.The learned counsel for the petitioner submitted that even according to the prosecution, the petitioner/A1 had attacked the deceased on the right leg, which shows that the petitioner had no intention to kill the deceased. It is further submitted that the occurrence had taken place in a sudden provocation. He further submitted that the second and third accused were granted bail by this Court in Crl.O.P.No.11990 of 2015 on 29.06.2015.

4.Heard the learned Government Advocate (Crl.side) appearing for https://hcservices.ecourts.gov.in/hcservices/ the State.

5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Kuzhithurai, and on further condition that the petitioner shall stay at Trichy and he shall appear before Contonement Police Station daily twice at 10.00 a.m and 06.00 p.m until further orders. sd/- 15/07/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
