(Order of the Court was made by D. KRISHNAKUMAR, J.) Prayer in the Writ Petition is to quash the impugned order passed by the third respondent, dated 16.08.2013. 2.When the matter was taken up for hearing today, the learned counsel appearing for the third respondent would submit that challenging the very same impugned order, dated 16.08.2013 passed by the third respondent, the fourth respondent/owner of the property in question has filed a Writ Petition in W.P(MD)No.15546 of 2013 and the same was dismissed on 12.02.2024 and the present Writ Petition has been filed by the petitioner as a tenant.

3.Considering the submission made by the learned counsel appearing for the third respondent, we are of the view that in the light of the order passed by this Court in W.P(MD)No.15546 of 2013, dated 12.02.2024, the merits of the case cannot be decided in this Writ Petition. Further, the Writ Petition has been filed by the petitioner as a tenant and the same cannot be entertained.
4.Accordingly, the Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. [D.K.K.,J.] [R.V.,J.] 28.02.2024 NCC : Yes / No Index : Yes / No ps 3/5
