ORDER

This Criminal Original Petition has been filed to direct the 1st respondent to conduct the primary enquiry in pursuance of the petitioners complaints dated 05.09.2023 and 04.01.2025 pending before the 2nd respondent 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents. Perused the materials available on record.

3.The contention of the petitioner is that the marriage between the petitioner and one Peer Mohammad taken place in the year 2019 and immediately, after the marriage the petitioner was subjected to cruelty for demand of dowry. The petitioner's husband was employed in Qatar and on 12.06.2023 through postal he had sent a Talaq to the Peravurani Jamaat, thereafter, the petitioner came to know that the petitioner's husband had planned to marry one Fatima. Therefore, the petitioner lodged a complaint on 04.01.2025. Based on her complaint, enquiry has been conducted in CSR No.1 of 2025. Thereafter, no action has been taken.

4.The learned Additional Public Prosecutor submitted that it is a matrimonial dispute and the petitioner's complaint is being considered by the respondent police.

5.In view of the same, the petitioner is directed to appear before the respondent police on 31.01.2025 and the respondent police will ensure the presence of counter petitioner and thereafter, conduct inquiry and complete the investigation within a period of two months from the date of appearance of parties.

6.With the above directions, the petition stands disposed of. 22.01.2025 NCC : Yes/No Index : Yes / No Internet : Yes / No PNM 3/5
